The discovery and disclosure of electronic information is sometimes without authorization and may give rise to a civil action (known as a “tort”) and may also, in some particular incidents, violate State and Federal law.
Celebrities have been victims of invasions of privacy for years – remember the Pamela Anderson/Tommy Lee sex tape? These days, celebrities are not the only victims as ordinary people become victimized by estranged spouses, romantic partners, and even strangers.
North Carolina has just passed a Revenge Porn law. North Carolina is one of 26 states (and counting; 11 states have bills pending as of this post) that criminalizes revenge porn. Of the 26 states with revenge porn criminal penalties, North Carolina is one of only 9 that have civil remedies also. (NC and Cali leading the way… wait… say that again?) For every day the illegal post is online, civil damages accrues at $1,000 per day or $10,000 whichever is higher, plus punitive damages, plus attorney fees. Whomp.
